After receiving a notice of denial, the first essential step is to petition for reconsideration.

The request for reconsideration must be filed with the Social Security Administration (SSA) within 60 days of receiving your notice of denial of your initial application. The reconsideration phase looks a lot like the initial application stage. In most cases, a new claims examiner will review your case on reconsideration, looking over the same documentation, as well as:

  • Any additional information: This is the opportunity to provide any new medical information that has come up since filing the initial application or provide information that was left out the first time.
  • Explanation of why you don’t agree with the denial: You will have the opportunity to explain why the denial was unfounded, and why you should indeed receive the benefits you are claiming.
  • Medical records: Again you will need to file all of the appropriate medical documentation for the SSA to review.
