Can I pursue disability benefits after a disabling car crash?

A car crash is always an unexpected event. If it renders one of the victims permanently disabled, it's even more unexpected. In some of these situations -- and depending on the nature and extent of the disability -- the problem could be a lifelong condition that prevents the injured party from working. In cases like this, you might be able to receive government benefits by pursuing a Social Security Disability (SSD) claim.

Those who qualify for government benefits are individuals who have paid a sufficient amount into the United States Social Security system. In other words, they have worked and paid their taxes for long enough to satisfy the minimum requirements. These requirements change from year to year as you grow older. For example, younger workers do not need to have worked and paid as much into the system as older workers to qualify for disability benefits.

In addition to satisfying the past payment requirement to receive disability benefits, you also need to have a health condition that prevents you from working and earning an income. This disability needs to prevent you from earning an income for at least a year, or it needs to be fatal.

Once the disabled car accident victim satisfies the requirements referenced above, and the Social Security Administration (SSA) approves his or her claim, the individual can start to receive benefits.

The SSD application process is not entirely cut and dry. If you need help or assistance getting approval for your claim -- or if your initial claim was denied, and you don't know what to do -- our law office is available to come to your aid.
