The Social Security Disability process from start to finish is unfortunately a longer process than most expect. There are several steps that have to happen once you file your application. It is also important to note that each of these steps take time as well. Once you file your application, it can take several months to get an initial disability decision on whether they have found you disabled or not. Majority of cases are denied at initial application. If the Social Security Administration denies your initial application, you have the opportunity to appeal that decision and ask for “reconsideration.” This again can take several months and even sometimes up to 2 years (depending on the state you reside in) before you receive a reconsideration decision. Some cases might be awarded at this level. However, again, majority of cases are also denied at the reconsideration level. If you are denied disability at the reconsideration level, you can request a hearing before an administrative law judge. This hearing will take some time to schedule, and you will receive notice of this hearing date at least 75 days in advance. Then once you attend your hearing, it can take anywhere from 60-90 days to receive the decision from the judge. Overall, as you can see, the Social Security Disability process is a lengthy one with many steps. While sometimes the process can seem never-ending or frustrating but hang in there! It is important that you communicate and cooperate with Social Security and your hired representatives to ensure the process goes as smoothly as possible. Also, by hiring an experienced law firm like Midwest Disability, you won’t be alone in this process – they will help guide you every step of the way!
