Disability Claims Are Not Automatically Approved
About four million people live here, and each year thousands of our residents are hurt and they need benefits. They have disabilities that keep them from returning to work. Those numbers include children who cannot return to school.
Social Security Disability Insurance is our nation’s safeguard, with benefits for people who are not able to work due to a significant illness or impairment that could last a year or longer. Of the program’s applicants in Indiana, about 70 percent are denied the first time they apply.
Those applicants must then file a Request for Reconsideration, which is the first part of the appeal process. The Social Security Administration grants less than 20 percent of those requests. Those denied must schedule a disability hearing before an administrative law judge.
The Process Can Be Long And Draining
It typically takes a year to a year and a half for the hearing to be scheduled. It can take another three months for a decision. This can create significant financial burden for people who are not able to work.
The bad news is that Indiana’s acceptance rate is less than the national average. Our state’s appeal denial rate is also significantly lower than the national average.
If you are going through this process, there are questions.
You might be asking:
- Am I eligible?
- What do I do if my claim was denied?
- What can I expect at my disability hearing?
