How long will it take for a decision?
After you apply for Social Security Disability (SSD), it can take three to five months or more before you receive a decision from the SSA.
What if my claim is denied?
If the SSA denies your SSD or SSI claim, you have the right to appeal. In most states, the first step in that process is a Request for Reconsideration. You have 60 days in which to file a Request for Reconsideration after receiving a denial notice. Generally speaking, however, the reconsideration stage of the appeals process almost always produces a second denial.
The next step (or the first step if your state doesn’t have the Reconsideration step) is to request a hearing before an administrative law judge (ALJ). The ALJ hearing is where most disability claims are won and it is your first opportunity to really make your case directly to a decision-maker.
Unfortunately, it currently takes about 18 months to get an ALJ hearing scheduled, which is yet another reason to apply for Social Security Disability benefits as soon as possible.
